1. THE PROMOTER

2. THE COMPETITION

2.1 These Terms and Conditions apply to all competitions listed on the promoter’s website at www.clubhousecompetitions.com (the “website”).

2.2 An entry fee is payable each time you enter via our online entry method or you may enter for free via the postal entry method detailed below. Each person who enters either via the online entry route or the postal entry route is an “Entrant” for the purpose of these Terms & Conditions.

3. HOW TO ENTER

3.1 The competition will run from the published opening and closing times specified on the website. These dates shall be referred to as the “opening date” and “closing date” respectively. All times and dates referred to are the times dates in London, England (GMT)

3.2 If it is absolutely necessary to do so, due to circumstances beyond the control of the Promoter, the Promoter reserves the right to change the “opening date” and “closing date” of the competitions, the new details will be displayed on the website. The Promoter will not extend the closing date simply to sell more entries.

3.3 All entries, both online entry route and postal entry route must be received by the promoter no later than the specified closing date and time. All entries, both online and postal received after the specified closing date and time are automatically removed; the Promoter confirms that no refunds will be given.

3.4 The maximum number of entries to the individual competitions will be stated on the website. The number of entries an entrant is able to make may be limited if the maximum number of entries has been reached.

3.5 Entrants can enter the competition, as many times as they wish, until the maximum number of entries allowed per entrant has been reached for the individual competition, or until the maximum number of entries has been received.

3.6 Entrants submitting an entry via a postal entry route must submit each individual entry separately. Bulk entries received for any competition will not be accepted and will only be counted as one single entry.

4. TO ENTER A COMPETITION ONLINE

All of our competitions can be entered either via the paid entry route online or via the postal entry route. As an additional feature, some competitions may offer a multiple-choice question that must be answered correctly in order for your entry to be submitted into the competition draw.

Draw Based Competitions

Step 1: Go to the website www.clubhousecompetitions.com and register an account.

Step 2: Pick the competition(s) you wish to enter.

Step 3: Purchase the required number of entries for each competition.

Step 4: Complete the payment to receive your order confirmation and ticket numbers

Step 5: Once the Competition has been drawn you will be notified by email if you are a winner

Instant Win Competitions

Step 1: Go to the website www.clubhousecompetitions.com and register an account.

Step 2: Pick the competition(s) you wish to enter.

Step 3: Purchase the required number of entries for each competition

Step 4: Complete the payment to receive your order confirmation and ticket numbers.

Step 5: You will be alerted on the prize page if you have won an Instant Cash Win. Instant Site Credit wins will automatically be added to your Clubhouse account via your Clubhouse online wallet on our website.

4.1 All entries must be submitted in the English Language, entries in languages other than English will automatically be disqualified and no refund will be given.

4.2 The promoter will send confirmation by email to the entrants nominated email address (requested during the registration process), that the entry has been received and confirm ticket numbers.

4.3 The promoter will not accept responsibility for competition entries that are not successfully completed, are lost or delayed regardless of cause, including, for as result of any equipment failure, technical malfunction this includes any failure of any kind of systems, network, server, computer hardware, or computer software.

4.4 By purchasing entries and submitting a competition entry, you are entering into a contract with the promoter and are agreeing to be bound by these Terms & Conditions.

4.5 By entering, all entrants are confirming that they are over 18 years of age.

5. TO ENTER A COMPETITION VIA POSTAL ENTRY

All of our competitions can be entered either via the paid entry route online or via the postal entry route. As an additional feature, some competitions may offer a multiple-choice question that must be answered correctly in order for your entry to be submitted into the competition draw.

The entrant may enter the competition (Either Draw Based or Instant Win) via a free postal entry by complying with the following rules:

5.1 Entrants should send their entry by either first-class or second-class post to the promoter at the following address: Clubhouse Competitions, PO Box 1245, Aylesbury, HP20 9QX.

5.2 Hand delivered entries will not be accepted and will not be entered into the random draw.

5.3 Entrants should include on their postal entry, the following information:
a) Entrants full name
b) Entrants full address and postcode
c) A contact telephone number and email address.
d) The competition you would like to enter

5.4 Incomplete or illegible entries will be disqualified.

5.5 Entrants must also register and create an account on the promoters website.

5.6 The Entrant may make multiple free postal entries for any competition (Up to the limit placed on entries by the promoter by entrants) but each postal entry must be submitted and posted to the promoter separately (each postal entry received will be allocated one ticket for the nominated competition). Bulk entries in one envelope will not be accepted as multiple entries, in the eventuality that the Promoter receives a bulk entry it will be counted as one single ticket.

5.7 Whilst the Promoter will only allow one entry per postal entry it is recognized that certain competitions run by the promoter may be cheaper through the paid online route than via the postal entry route.

Therefore, if the paid online entry route is less costly than the price of a first-class stamp (£1.70), the following pricing adjustment will apply:

Example 1

Paid entry cost per ticket: £0.19
Number of tickets awarded: 9
Total value of tickets 9 x £0.19 = £1.71

Example 2

Paid entry cost per ticket: £0.79
Number of tickets awarded: 3
Total value of tickets 3 x £0.79 = £2.37

5.8 By entering the competition the entrant is confirming that they are eligible to enter (aged 18 or over) and accept these Terms & Conditions.

5.9 All entries must be received by the advertised closing date and time of the competition entered (closing date and time will be advertised by the promoter on the website). Entries received after the closing date will not be entered into the draw. Whilst any postal entries received after the closing date and time of the competition entered will not be entered into that competition, the promoter will award to the entrant (via postal entry route) a site credit up to the value of the ticket for the competition entered for a period of 72 hours after the advertised closing date. Proof of postage does not guarantee you will be entered into the draw.

5.10 The promoter will acknowledge to entrants using the postal entrant route that they are entered into their nominated competition, as long as the promoter has:
a) Received the postal route entry by the closing date and time of the competition entered
b) The Entrant has fully completed the required registration process as detailed in clause 5.3
c) A ticket has been awarded

5.11 If the number of entries received have reached any capacity of limit before the entrant’s postal entry is received the entrant will not be entered into the draw and site credit will be awarded to the entrant up to the value of the ticket price for the nominated competition entered.

5.12 If the promoter considers an entrant submitting postal entries in the name of, or on behalf of other individuals, the promoter reserves the right to exclude the entries from the competition entered. This may result in the account of the entrant being temporarily suspended or closed.

5.13 Once received by the promoter, all postal entries become the property and shall not be returned, nor will postal costs be reimbursed to the entrant.

6. CHOOSING A WINNER

6.1 All entrants who have correctly completed the registration process, and have completed the purchase of tickets online, or have fully adhered to the free postal entry route will be entered into the entrant’s nominated competition. The draw will take place as soon as reasonably possible, and on the same day as the advertised closing date. The draw will only be extended in very exceptional and unavoidable circumstances beyond the promoter’s control which make it necessary to do so. If this happens the draw will take place at the first available opportunity and be displayed on the Promoter’s website and social media platforms accordingly.

6.2 All entrants will have their names and entry numbers (ticket numbers) included on a spreadsheet which may be published on the website, and will be visible during the live draw. If an entrant does not wish to have their name included on this spreadsheet you must contact the promoter via email at info@clubhousecompetitions.com as soon as reasonably possible after the entrant has completed their entry, and in any event at least 48 hours before the live draw takes place.

6.3 Due to the nature of the promoters draw-based, competitions there will only be 1 winner per competition unless the promoter clearly states otherwise

6.4 For all Instant Win Competitions there will be only 1 winner per ticket, for tickets purchased that have been assigned an instant win prize (The ticket numbers that have an instant win prize attached are clearly displayed on the competition website).

7. ELIGIBILITY

7.1 The Competition is only open to residents in England, Scotland & Wales aged 18 years and over, except:

a) Employees of the Promoter
b) Employees of agents, or suppliers of the Promoter, who are professionally connected with the competition or its administration.

7.2 By entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. If you win, the Promoter will require you to provide proof that you are eligible to enter the competition and claim the prize. If you fail to provide the promoter with any such proof or other information that they may require within a reasonable time, you may be disqualified from the competition and will forfeit your prize with no refund entitlement. If this happens, the promoter will re-draw the competition from the other entrants who previously entered that specific competition draw.

7.3 The Promoter will not accept competition entries that are:

a) Automatically generated by computer.
b) Incomplete

7.4 The promoter reserves the right to disqualify an entrant if their conduct is contrary to the spirit or intention of the prize competition. This includes if you are rude or abusive to the Promoter or anyone associated with them.

7.5 No refunds of entry fee will be given in any event, including:

a) If following an entrant entering the competition, the entrant subsequently find out they are not eligible to enter the competition or claim the prize.
b) If following an entrant entering into the competition the eligibility criteria for entering the competition or claiming the prize changes and the entrant is no longer eligible.
c) If you are disqualified from the competition by the promoter for any reason.

7.6 If the entrant engages in any of the following:

a) Any form of fraud (Actual or Apparent);
b) Fraudulent Misrepresentation;
c) Fraudulent Concealment;
d) Hacking or interference with the proper functioning of the website;
e) Amending, or unauthorized use of any of the code that constitutes the website;

All of the entrant’s entries will be declared void, no refunds will be given and they may be prevented from participating in any future competitions.

8. THE PRIZE

8.1 The prize for each competition is described on the website (“the prize”). Details of the prize are, to the best of the promoter’s knowledge, information and belief, correct as of the opening date.

8.2 Prizes are subject to availability. The promoter reserves the right to substitute any prize with a prize of equal or greater value. If any details of the prize change, the promoter will endeavor to update the website as soon as reasonably possible.

8.3 The promoter makes no representations and gives no warranties about the prize, its value, its condition or any other information provided on the website.

8.4 The promoter makes no representations and gives no warranties that the information provided on the website is accurate, complete or up to date.

8.5 Some prizes, such as experiences, may be supplied by a third-party supplier (the “supplier”) who we may have partnered with specifically for that prize.

8.6 There is no cash alternative for the prize unless stated or the option is presented to the selected winner.

8.7 The prize is not negotiable or transferable.

8.8 The promoter reserves the right to substitute the prize for an alternative cash prize (“cash prize”) of the same value as the original prize in the following circumstances:

a) The prize becomes unavailable;
b) Other circumstances beyond the reasonable control of the promoter make it necessary to do so

9. WINNERS

9.1 The decision of the promoter is final, and no correspondence or discussion will be entered into.

9.2 The promoter will contact the winner personally as soon as practicable after the draw date, using the telephone number and/or email address provided with the competition entry. If the winner cannot be contacted or is not available or has not claimed the prize within 14 days of the draw date, the promoter reserves the right to re-draw the prize with all the eligible entrants who previously entered that competition.

9.3 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the promoter will publish the name and/or surname of major prize winners on the website or send the name and /or surname and county of major prize winners to anyone who writes to the address set out in clause 1 (enclosing a stamped, self-addressed envelope) within one month after the closing date of the competition.

9.4 If you object to any or all of your surname, county and winning entry being published or made available, please contact the promoter at info@clubhousecompetitions.com prior to the closing date. The promoter must receive this objection at least 24 hours before the draw takes place. In such circumstances, the promoter must still provide the information to the advertising standards authority on request.

9.5 Winners will be asked for their consent to provide photographs and pose for photographs & videos with their prize and have their personal details (including details of any prize won by them) included in marketing material. If the winner consents to this, the foregoing photographs, videos and marketing material may be used in future marketing and public relations by the Promoter in connection with the competition and in identifying them as a winner of a competition through Clubhouse Competitions.

10. CLAIMING THE PRIZE

10.1 You must claim the prize personally – A third party on your behalf may not claim the prize. We will contact you to either arrange the free delivery of your prize to the address in Great Britain as stated on your account, or made available for your collection if you prefer. If you are collecting the prize from the promoter in person, this must be pre-arranged and agreed with the promoter and all expenses incurred to collect the prize are the responsibility of the winner. All prizes which are posted will only be sent by recorded delivery where a signature may be required from the winner. Refusal to do this will result in the winner forfeiting their prize.

10.2 If your personal details, including contact information, change at any time you should notify the promoter as soon as reasonably possible. Notifications should be sent to the promoter via email to info@clubhousecompetitions.com. Notifications must include details of the competition you have entered, your old details and your new details. If your details change within 7 days of the closing date, the promoter may use your old details if it needs to try to contact you.

10.3 Any cash prize will be transferred directly to the winners nominated bank account. The winner must provide evidence that it is the sole or joint beneficiary of the bank account. Failure to do so within 14 days will result in disqualification from the competition and the winner forfeiting the prize. In such circumstances, the promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the closing date.

10.4 The promoter does not accept any responsibility and is not liable to pay any compensation if you are unable to or do not take up the prize.

11. LIMITATION OF LIABILITY

11.1 To the maximum extent permitted by law, Clubhouse Competitions shall not have any liability to you or any winner in connection with or arising from any draw howsoever caused, including costs, expenses, damages, and any other liabilities, provided that nothing in this clause shall limit our liability for personal injury or death caused by our negligence. Our total maximum aggregate liability to each winner shall be limited to the total value of any one prize. Our total maximum aggregate liability for non-winners shall be limited to the amount paid to enter the draw.

Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for any: (a) losses that were not foreseeable to you and us when these terms were formed; (b) losses that were not caused by any breach on our part; (c) business losses; and (d) losses to non-consumers.

12. DATA PROTECTION & PUBLICITY

12.1 By entering the competition, you agree that any personal information provided by you with the competition entry may be held and used only by the promoter or its agents and suppliers to administer the competition or as otherwise set out in the promoter’s privacy policy (clubhousecompetitions.com/privacy-policy), a copy of which is available on the website.

12.2 If you are the winner of the competition, you agree that the promoter may use your name, image and town or county of residence to announce the winner of this competition. You further agree to participate in any reasonable publicity required by the promoter.

12.3 If you do not wish to participate in any publicity, you must notify the promoter prior to the closing date. This will not affect your chances of winning the prize. If you do not agree to participate in any publicity about the competition, we may still provide your details to the advertising standards authority. This is a legal requirement that we must comply with to prove that the competition has been properly administered and the prize awarded.

12.4 If you are the winner of the competition, you may be required to provide further personal information and proof of your identity in order to confirm your eligibility to claim the prize and transfer ownership of the prize to you. You consent to the use of your information in this way. You are entitled to request further details about how your personal information is being used. You may also withdraw your consent to your personal information being used in such a way but by doing so you may prevent the prize being transferred to you. In such circumstances, you will be deemed to have withdrawn from the competition and forfeit the prize. You will not be entitled to any refund of your entry fee. The promoter reserves the right to offer the prize to the next eligible entrant selected from the entries that were received before the closing date.

12.5 Please note that under data protection laws you are entitled to request that the promoter does not contact you and removes your details from its database. If you make such a request, you will be withdrawing from the competition as it will not be possible to contact you in the event that you are the winner. You will not be entitled to any refund of any entry fee if you withdraw from the competition. If you do not wish any of your personal details (such as your name and town / county) to be used by the promoter for promotional purposes, please email the promoter at info@clubousecompetitions.com prior to the closing date.

12.6 Entrants who specifically consent to marketing communications will be entered onto the Promoter’s database for the purpose of conveying information as to the status of the competition, as well as any future promotions or competitions offered by the Promoter.

13. GENERAL

13.1 The promoter reserves the right to amend these terms and conditions from time to time. The latest version of these terms and conditions will be available on the website.

13.2 If there is any reason to believe that there has been a breach of these terms and conditions, the promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition and any future competitions.

13.3 The promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so. There is no minimum number of entries, and the promoter will not hold void, suspend, cancel, or amend the prize competition due to a lack of entries.

13.4 The competitions on the website are in no way sponsored, endorsed, administered by or associated with TikTok, YouTube, Facebook, Instagram or any other META platforms. By entering the competitions, entrants agree that TikTok, YouTube, Facebook, Instagram or any other META platforms has no liability and is not responsible for the administration or promotion of the competitions.

13.5 These Terms & Conditions shall be governed by the laws of England, and Wales and the parties submit to the exclusive jurisdiction of the courts of England and Wales.

13.6 You should print a copy of these Terms & Conditions and keep them for your records.
